Privacy Notice - Evelyn Partners (US)

Introduction

This document sets out Evelyn Partners Asset Management Limited’s (“Evelyn Partners”) obligations under US Federal law. It describes the way that Evelyn Partners collects, retains, shares, and protects your personal information.

Evelyn Partners will only disclose non-public personal information about its clients or former clients to third parties in order to provide a service to those clients, for example to assist in opening a custodial account, or as part of its regulatory obligations or when instructed by court order.

What information does Evelyn Partners collect?

Evelyn Partners collects personal information about its clients in connection with providing advisory services to them.  This information includes their social security number and may include other information such as their:

  • Assets;
  • Investment experience;
  • Transaction history;
  • Income; and
  • Wire transfer instructions.

Evelyn Partners collects this information from clients through various means. For example when they give Evelyn Partners their contact information, enter into an investment advisory contract with Evelyn Partners, tell Evelyn Partners where to send money, or make a wire transfer. Evelyn Partners may also collect personal information from its website, and the website Privacy Notice may be viewed here.

How Evelyn Partners uses this information

All financial companies need to share customers’ personal information to run their everyday business, and Evelyn Partners uses the personal information collected from clients for everyday business purposes. These purposes may include for example:

  • To provide discretionary investment management services
  • To open an account
  • To process a transaction
  • As part of its regulatory obligations (for example, US FATCA)
  • To respond to court orders and legal investigations

Evelyn Partners may provide personal information to firms that assist us in servicing clients’ accounts and have a need for such information, such as a broker, asset management software provider, custodian or fund administrator.  Evelyn Partners may also disclose such information to service providers and financial institutions where clients have given specific authorisation to do so, for example to a lawyer, accountant, or financial adviser.

These sharing practices are consistent with US Federal privacy and related laws, and in general, clients may not limit Evelyn Partner’s use of personal information for these purposes under such laws.  Evelyn Partners notes that the Federal privacy laws only gives clients the right to limit certain types of information sharing, however Evelyn Partners does not engage in relevant activities, for example sharing any personal information with others in order for them to market to clients.

How we protect your personal information

To protect clients’ personal information from unauthorized access and use, Evelyn Partners uses security measures that comply with US Federal law.  These measures include computer safeguards, secured files and building security.
